Terms of Service

1. Acceptance of Terms

By accessing or using OurLens ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

OurLens is an event photo-sharing platform that allows event organizers to create shared photo galleries accessible via QR codes. Guests can upload photos without creating an account or installing an app.

3. User Accounts & Access

Event organizers receive a unique, private dashboard link upon event creation. You are responsible for keeping this link confidential. Anyone with access to your dashboard link can manage your event. We are not responsible for unauthorized access resulting from shared or compromised links.

4. Acceptable Use

You agree not to:

• Upload illegal, offensive, or harmful content
• Upload content that infringes on others' intellectual property rights
• Use the Service for unauthorized commercial purposes
• Attempt to access other users' events or data without authorization
• Interfere with or disrupt the Service or its infrastructure
• Use automated tools to scrape or bulk-download content
• Upload malware, viruses, or other malicious files

We reserve the right to remove content and terminate access for violations of these terms without prior notice.

5. Content Ownership & License

You retain full ownership of any photos you upload to OurLens. By uploading content, you grant us a limited, non-exclusive license to store, process (e.g., generate thumbnails), and serve your content solely for the purpose of operating the Service.

This license terminates when your content is deleted, either by you, by the event organizer, or automatically upon event expiration.

6. Payments & Refunds

Paid tiers are one-time payments processed through Stripe. Prices are displayed in USD and include the full cost of the selected retention period.

• Payments are non-refundable once the event has been started (activated).
• If you experience a technical issue preventing use of the Service, contact us within 48 hours for a case-by-case review.
• Tier upgrades are charged as the full price of the new tier. The difference from any previously paid tier is not credited.

7. Data Retention

Photos and event data are stored for the duration of the selected retention tier. After expiration, data is permanently deleted within 24 hours. We are not responsible for data loss after the retention period. Event organizers should download their photos before the event expires.

8. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. We may perform maintenance, updates, or modifications that temporarily affect availability. We are not liable for any losses resulting from service interruptions.

9. Limitation of Liability

To the maximum extent permitted by law, OurLens and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of photos, data, revenue, or profits, arising from your use of the Service.

Our total liability for any claim related to the Service shall not exceed the amount you paid for the specific event in question.

10. Indemnification

You agree to indemnify and hold harmless OurLens and its operators from any claims, damages, or expenses arising from your use of the Service, your content, or your violation of these Terms.

11. Changes to Terms

We may modify these Terms at any time. Continued use of the Service after changes constitutes acceptance. We will make reasonable efforts to notify users of significant changes.

12. Governing Law

These Terms shall be governed by and construed in accordance with applicable law. Any disputes arising from these Terms or the Service shall be resolved through good-faith negotiation before pursuing formal proceedings.
